TERMS OF USE

Aspire Broadband Terms of Use

1. Acceptance of Terms

By accessing or using the services provided by Aspire Broadband ("Aspire," "we," "us," or "our"), including but not limited to broadband internet access, equipment, applications, and related services (collectively, the "Services"), you ("Customer," "you," or "your") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

2. Services Provided

Aspire offers residential broadband internet services with symmetrical speeds via a 100% fiber-optic network. Service plans include:

  • Fast (500 Mbps): $70/month

  • Faster (1 Gbps): $90/month

  • Fastest (2 Gbps): $110/month

All plans include:

  • Free home installation

  • Free Wi-Fi 6 router

  • No data caps

  • Symmetrical Speeds

  • Access to the Aspire Smart Home App (featuring parental controls, cyber controls, usage reports, and cyber protection)

3. Billing and Payment

3.1 Monthly Billing

Services are provided on a month-to-month basis. By subscribing, you authorize Aspire to bill your designated payment method monthly in advance for the selected service plan and any applicable taxes or fees.

3.2 Payment Methods

Payments can be made via credit/debit card or ACH transfer. To qualify for promotional offers, customers must enroll in both autopay and paperless billing. Failure to maintain these enrollments may result in the forfeiture of promotional discounts.

3.3 Late Payments

Payments are due on the billing date specified in your account. Late payments may result in service suspension or termination. Aspire reserves the right to charge late fees as permitted by applicable law.

4. Promotions and Discounts

Promotional offers are contingent upon enrollment in autopay and paperless billing. Aspire reserves the right to modify or terminate promotional offers at any time. Eligibility for promotions is determined at Aspire's sole discretion.

5. Equipment and Installation

Aspire provides customers with the equipment necessary to access the Services, including a Wi-Fi 6 router, at no additional cost. All Aspire-provided equipment remains the property of Aspire Broadband.

Upon termination of Services for any reason, the customer is required to return all Aspire-provided equipment in a timely manner, in accordance with return instructions communicated by Aspire at the time of service cancellation.

Aspire reserves the right to determine the return method, which may include drop-off, or another designated process. A $250 non-return fee will be charged to the customer's account if equipment is not returned as required.

6. Acceptable Use Policy

Customers agree to use the Services in compliance with all applicable laws and Aspire's Acceptable Use Policy. Prohibited activities include, but are not limited to:

  • Unauthorized access or use of data, systems, or networks

  • Transmission of unlawful, harassing, defamatory, or threatening content

  • Distribution of viruses, malware, or other harmful software

  • Engaging in activities that disrupt or degrade network performance

Aspire reserves the right to suspend or terminate Services for violations of this policy.

7. Service Availability and Performance

While Aspire strives to provide uninterrupted Services, we do not guarantee continuous availability. Factors beyond our control, such as network congestion, system upgrades, or maintenance, may affect service quality. Aspire is not liable for service interruptions or performance issues.

8. Termination

Either party may terminate the Services at any time. Upon termination, customers must return all Aspire-provided equipment in accordance with Section 5. Aspire may terminate Services for non-payment, violation of these Terms, or other lawful reasons.

9. Limitation of Liability

Aspire shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or relating to the use or inability to use the Services. Aspire’s maximum liability under any theory of law shall be limited to the total amount paid by the customer to Aspire for the Services in the three (3) months immediately preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Aspire, its affiliates, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising out of or in any way related to your use of the Services or violation of these Terms.

11. Dispute Resolution

Any disputes arising under these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in the state where the Services are provided, unless otherwise agreed by both parties. You agree to waive your right to file a lawsuit in court or participate in a class action related to any disputes.

12. SMS Terms of Service

By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from Aspire Broadband. This includes SMS messages for appointment scheduling, appointment reminders, post-visit instructions, lab notifications, and billing notifications. Message frequency varies. Message and data rates may apply. See privacy policy at https://www.aspirebroadband.com/privacy-policy. Message HELP for help. Reply STOP to any message to opt out.

13. Changes to Terms

Aspire reserves the right to update or modify these Terms at any time. Changes will become effective upon posting to Aspire's website. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes.
